Slip And Fall Is About Negligence, Not Clumsiness

Georgia law requires owners of commercial property to keep their land and buildings reasonably safe for people on the property for reasons related to the company’s business.  The law makes sense: the owner knows better than a guest where the hazards are and is the one who can fix the problem.  However, just because someone gets hurt on a company’s property does not mean that the injured party is automatically entitled to recover monetary compensation.  An over-simplified explanation of the legal framework for slip- or trip-and-fall cases is that:
1.  The owner has to do something wrong;
2.  The injured person had to be careful and not do anything wrong;
3.  Once 1 and 2 above are met, the injured person has to prove the injury was because the owner did something wrong; and
4.  The injured person has to prove the value of his or her injury.
Atlanta-based property owners and their designated managers and staff must be reasonably vigilant when it comes to safety. Once the owner knows, or should have known, of a hazardous condition, reasonable steps should be taken to eliminate the danger.  Awareness of a slippery surface requires immediate action to protect customers. Ignoring or putting off notification can lead to serious injuries.

Customers should be equally vigilant.  You don’t have to pay attention to where you put your foot on every step, but you need to be aware of things that might cause you to slip or trip.

What To Do Following A Slip-And-Fall Accident

Slipping and falling in public may be embarrassing, but don’t let your embarrassment overcome the need to tell someone if you are hurt.  If something happens, make sure you tell an employee. Take a few pictures with a mobile device.  Get the names of the employees you talk to and any witnesses who saw you fall.  Take pictures, if you can, of what caused you to fall.  Notice if there are any security cameras in the area and ask an employee to make sure the video is saved.
